Is CBD Legal? Marijuana-derived CBD products are illegal on the federal level, but are legal under some state laws. Hemp-derived CBD products (with less than 0.3 percent THC) are legal on the federal level, but are still illegal under some state laws. Check your state's laws and those of anywhere you travel. Keep in mind that nonprescription CBD products are not FDA-approved, and may be inaccurately labeled.

In regards to the use of CBD, one must be careful to choose a product that has little to no quantity of THC, especially if one lives in a state where it is illegal. Still, many high-quality products meet this criterion and are thus legal for usage. Please also note, there are not many studies on the use of each of these individual products, and therefore, users should start at lower doses and increase slowly.
